Chest Disease (COPD) Claims
Every claim is individual but here are some examples of situations where claimants were not advised properly. Even if none of these apply to you, call us to discuss your claim.
Fast Track claims
- In 2005, fast track schemes were introduced for both surviving miners and the families of deceased miners. This was a fixed sum awarded to the miner/family of the miner and only claims which hadn’t been through the full medical assessment process were potentially eligible for the scheme. If you did not receive information from your solicitor about the fast track scheme, CLICK HERE for a Call Back.
- In some cases, a higher level of compensation may have been awarded if the claim went through the full medical assessment rather than taking the fast track offer. If you were not advised of the option to continue through the full medical assessment, CLICK HERE for a Call Back.
Medical Assessment
In some cases not all the medical records were included in the assessment or the facts in the medical report are wrong. If the medical report was not explained to you and if you were not asked for your comments and instructions on it, CLICK HERE for a Call Back.
Offer of Compensation
Each claimant's offer is calculated individually on the basis of the available evidence. If the calculation of the offer was not explained to you or you are worried that the claim was not investigated properly, CLICK HERE for a Call Back.
If your claim was denied and you did not receive any compensation, CLICK HERE for a Call Back.
Co Defendants
If you worked for a small or private mine or a coal mining contractor you may also have been entitled to claim against them. If you didn't receive compensation for employment outside British Coal, CLICK HERE for a Call Back.
Missed Deadlines
COPD claims had to be registered by 31st March 2004 and deadlines had to be met during the claims process. If you have been told by your solicitor that they have made a mistake or your claim failed because a deadline had been missed, CLICK HERE for a Call Back.
Deduction of Compensation
Some solicitors deducted some of their clients' compensation and haven't yet paid it back. If you didn't receive 100% of the compensation awarded to you, CLICK HERE for a Call Back.
